This is a summary. The full terms below apply.
1. About the Service and these Terms
These Terms govern the Kidspired children’s activity app and related website (the “Service”), operated by 9510-2729 Québec Inc., trading as Les Créations Kidspired, in Québec, Canada. “We” and “us” mean that business; “you” means the adult account holder or purchaser.
The Service provides educational and recreational activities for children and families, including parent-configured activity boards, calendars and routines. Features, prices and plan limits are described in the offer presented before purchase.
We ask you to accept these Terms when registering and separately authorize recurring charges when purchasing a subscription. Your purchase offer and confirmation form part of the agreement. Our Privacy Policy explains personal-information practices; accepting these Terms does not replace a separately required privacy consent.
Mandatory consumer protections take priority. Nothing here removes a statutory warranty, cancellation right, refund, privacy right or other remedy that cannot lawfully be waived.
2. Eligibility and your account
You must be at least 18, have reached the age of majority where you live and have legal capacity to enter into this agreement. Parents or legal guardians create and manage accounts. Children do not independently register or purchase subscriptions.
Provide accurate account information, protect your email and devices, and tell us if you suspect unauthorized access. You must have authority to manage each child’s profile and appropriate permission for content you upload.
The Service is for personal household use within your plan’s disclosed limits. Commercial, school or institutional use requires an offer expressly authorizing it. You are responsible for selecting suitable activities and supervising children as appropriate. Parent controls supplement, rather than replace, supervision and device security.
3. Subscriptions trials and billing
Monthly and annual billing options may be offered. Before purchase, we disclose the plan’s features and limits, price, currency, applicable taxes, billing interval, recurring-payment terms and cancellation method. An annual option is paid upfront for the stated access period unless the offer expressly says otherwise.
Subscriptions renew automatically unless cancelled, in the form permitted by applicable law and described in your offer. By affirmatively purchasing a recurring subscription, you authorize our payment processor to charge the disclosed subscription amount and applicable taxes at the agreed intervals. Required renewal and expiry notices apply.
A trial or promotion applies only when offered. Its duration, conditions, post-trial price and any automatic conversion are disclosed before acceptance. A trial cannot charge you without the required payment authorization. We provide purchase and contract information in a form you can retain.
If payment fails, we may notify you, retry the authorized charge and restrict paid access if the issue remains unresolved, subject to applicable law. A payment failure does not authorize undisclosed fees. Contact contact@getkidspired.com about billing errors or access problems.
4. Cancellation and refunds
You may stop subscription renewal at any time using the cancellation option provided with your account or by contacting contact@getkidspired.com. You do not need to give a reason. For ordinary cancellation of renewal, access continues until the paid period ends and there is no further renewal charge.
We generally do not refund unused time solely because you stop using the Service or cancel future renewal. This includes an annual period paid upfront. However, this policy does not override any legal right to immediate termination, reimbursement or another remedy. We correct billing errors and provide refunds required by law, including for qualifying cancellation, unauthorized charges or service failures.
Québec consumers retain applicable distance-contract and service-contract rights. Consumers elsewhere retain applicable withdrawal and digital-service remedies. Any legally required consent to immediate supply or acknowledgment affecting withdrawal rights must be obtained separately.
Deleting the app shortcut or stopping use does not cancel a subscription. Subscription cancellation does not itself delete family content. You can close an account yourself in the app, at any time, from Parent mode ▸ Settings ▸ Account & sync ▸ Delete my account; you are asked to type your email address to confirm. You can also contact contact@getkidspired.com and we will close it for you. Closure includes stopping future renewal. Retention and deletion follow the Privacy Policy.
5. Gift subscriptions
Gift subscriptions are a planned feature and are not represented by these Terms as currently available. If offered, their price, duration or value, delivery, activation, redemption and refund conditions will be shown before purchase.
A gift will be a one-time purchase and will not automatically charge the purchaser or recipient for a recurring plan. A recipient must be an eligible adult account holder. A code may be given to the intended recipient before redemption and, once redeemed, is associated with that household’s account, subject to applicable law.
The gift offer will distinguish unused-code validity from the end of activated access and explain any effect on an existing subscription. Expiration, transfer restrictions, refunds and treatment of unused entitlement must comply with applicable prepaid-value and consumer law. A gift does not give its purchaser access to the recipient’s family information.
6. Your content
You retain the rights you have in boards, photos, recordings and other content you provide. You give us a limited, non-exclusive permission to store, reproduce as technically necessary, transmit and display or play that content to provide the Service to your household. Our providers may perform those functions for us under appropriate arrangements.
This permission does not authorize unrelated advertising, public distribution or AI training using your family content. It ends when the content is deleted, except as necessary for lawful retention and backup handling described in the Privacy Policy. Personal information remains protected by privacy law.
You must have the necessary rights and permissions to upload content. Avoid including private or sensitive information about other people that an activity does not need.
7. Our materials and acceptable use
The software, artwork, Coco character, card illustrations, themes and other Service materials belong to us or our licensors. You may use them for the household purposes covered by your authorized access and any express feature permissions. You may not resell or redistribute them or copy the Service to build another product, except where applicable law permits the activity.
Do not use the Service unlawfully, upload abusive or exploitative content, infringe others’ rights, introduce malware, interfere with operation, access another household’s information or deliberately bypass access or payment restrictions. These rules do not prevent lawful complaints, privacy requests or consumer remedies.
8. Availability and intended use
Interruptions can occur because of maintenance, technical faults, provider outages or device and connectivity issues. We work to maintain the Service and address faults within a reasonable time, subject to applicable legal obligations. Some functions require connectivity even where offline features are available.
Kidspired supports family activities and planning. We do not promise a particular educational, behavioural or developmental result. It is not an emergency monitoring or medical reminder system; device settings and connectivity can prevent alerts.
Keep copies of important original content where practical. This recommendation does not excuse us from obligations regarding security, data integrity or remedies for losses caused by our conduct.
9. Suspension and service closure
We may restrict access where reasonably necessary to address a serious security issue, unlawful use, unresolved payment or a material breach, subject to applicable law. Where appropriate, we explain the reason and give an opportunity to resolve the issue. Urgent protective action may precede notice when legally justified. Contact contact@getkidspired.com to dispute a decision.
We do not have an unrestricted right to terminate a consumer contract at will. If we discontinue the Service, we provide legally required notice and refunds for prepaid service we will not supply, and a reasonable opportunity to request eligible information before closure. Account closure does not remove privacy or refund rights.
10. Warranties and responsibility
We provide the Service subject to the care, quality and other obligations required by applicable law. We cannot guarantee uninterrupted operation or complete freedom from errors. These limitations do not exclude statutory warranties or legally required remedies.
Nothing here excludes or limits liability that cannot lawfully be excluded or limited. We remain responsible to the extent required by applicable law. These Terms do not impose a financial liability cap or a blanket exclusion of responsibility for lost data on family consumers.
11. Changes to prices features and Terms
We may propose changes to account procedures, technical requirements, optional features and use rules for legitimate operational or legal reasons. Material reductions in the purchased Service and changes to essential contractual elements remain subject to applicable law.
An allowed future price change does not increase charges for a period already paid. We give at least 30 days’ written notice, or a longer period required by law, before a permitted material contractual or price change takes effect. The notice explains the change, effective date and applicable refusal or cancellation rights, including the previous and new text where required.
Québec consumers entitled to reject an amendment that increases their obligations or reduces ours retain the right to refuse and cancel without cost or penalty by notifying us no later than 30 days after it takes effect. Where affirmative agreement is required, we obtain it. Continued use alone does not impose a change that law does not permit. New privacy purposes are handled separately under our Privacy Policy.
12. Governing law language and disputes
Québec law and applicable Canadian federal law govern these Terms, subject to mandatory protections and conflict-of-law rules applicable to you. This does not remove non-waivable rights in your place of residence.
You may contact us about a dispute, but doing so is not a compulsory prerequisite to legal remedies. You retain access to competent courts and regulators. These Terms do not require mandatory pre-dispute arbitration, waive class proceedings or impose an exclusive judicial district.
French contractual documents are made available as required by Québec law. Any permitted choice to contract in another language follows the required French presentation and express-choice process. This English text does not itself waive rights to French documents.
If a provision is unenforceable, it is inoperative to the extent required by law. The remainder continues where legally appropriate. These Terms do not exclude binding representations, statutory rights or a written promise we make to you.
